Agreement to Terms

By downloading, installing, or using the miniboardmarket mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and miniboardmarket ("we", "us", "our").

Eligibility

You must be at least 13 years old to use miniboardmarket. By using the App, you represent that you are at least 13. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. You must not be prohibited from using the App under applicable law.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your contact information up to date
• Not share your account with others
• Notify us immediately of any unauthorized use of your account
• Not create multiple accounts or create accounts on behalf of others

We reserve the right to suspend or terminate accounts that violate these Terms.

Marketplace Rules

miniboardmarket is a peer-to-peer marketplace for fingerboards and related accessories. Users may buy and sell items subject to the following rules:

SELLERS MUST:

• Only list items they own and have the right to sell
• Accurately describe the condition, brand, model, and specifications of items
• Ship sold items within the stated handling time
• Provide valid tracking information when items are shipped
• Honor all completed sales

SELLERS MUST NOT:

• List counterfeit, stolen, or prohibited items
• Misrepresent the condition or authenticity of items
• Solicit payments outside of the miniboardmarket platform
• Cancel orders without valid reason

BUYERS MUST:

• Pay promptly using the in-app payment system
• Provide accurate shipping addresses
• Not attempt to pay sellers outside the platform

PROHIBITED ITEMS:

Items that are prohibited include but are not limited to: counterfeit goods, stolen property, hazardous materials, and any items prohibited by applicable law.

Fees and Payments

SELLER FEES:
miniboardmarket charges a platform fee on each completed sale:

• Standard sellers: 10.75% of the sale price
• Verified sellers: 8% of the sale price

Fees are deducted automatically from each payout. Seller payouts are processed via Stripe Connect. You must complete Stripe's identity verification to receive payouts.

BUYER FEES:
A buyer protection fee of $3.50 applies to purchases over $50. This fee is included in the total shown at checkout and covers transaction processing and buyer protection.

SHIPPING:
Shipping is charged to buyers at a flat rate. Sellers are responsible for shipping items as described. miniboardmarket may retain a portion of the shipping fee to cover label generation costs.

PAYMENT PROCESSING:
All payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. miniboardmarket does not store payment card information.

Buyer Protection

miniboardmarket offers buyer protection on eligible purchases. To be eligible for buyer protection, you must:

• Pay through the miniboardmarket platform
• Report issues within 72 hours of delivery (or 14 days of purchase if not delivered)
• Provide evidence of the issue (photos, tracking information)

miniboardmarket may issue refunds, require returns, or take other remedial action at our sole discretion. Buyer protection does not cover buyer's remorse, minor cosmetic differences not materially affecting value, or issues arising from inaccurate buyer-provided shipping addresses.

Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable law
• Attempt to circumvent the platform's fee structure by soliciting off-platform transactions
• Harass, threaten, or abuse other users
• Post false, misleading, or fraudulent listings
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Scrape, crawl, or use automated means to access the App
• Use the App to send spam or unsolicited communications
• Impersonate any person or entity
• Manipulate prices, reviews, or other marketplace metrics

Violation of these rules may result in permanent account suspension and may be reported to law enforcement.

Disputes Between Users

miniboardmarket is not a party to transactions between buyers and sellers. In the event of a dispute, we may facilitate communication but are not obligated to intervene or make binding decisions. We may, at our sole discretion, investigate disputes and take action including issuing refunds, suspending accounts, or restricting access.

Intellectual Property

The App, including its design, code, graphics, and content created by miniboardmarket, is owned by miniboardmarket and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. When you submit content (listings, photos, reviews), you grant miniboardmarket a worldwide, royalty-free license to use, display, and distribute that content in connection with operating the marketplace.

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted or error-free
• Items listed are authentic, as described, or of satisfactory quality
• Sellers will complete transactions
• Buyers will pay promptly

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINIBOARDMARKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY TRANSACTION ON THE MARKETPLACE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID IN FEES TO MINIBOARDMARKET IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless miniboardmarket and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the App, violation of these Terms, violation of any third party's rights, or any content you submit.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.

Changes to Terms

We may update these Terms at any time. We will notify you of material changes via push notification or email. Continued use of the App after the effective date of changes constitutes acceptance. If you disagree with the new Terms, you must stop using the App.
